AN ORDINANCE OF THE CITY OF QUINCY, FLORIDA PROVIDING FOR THE AMENDMENT OF CHAPTER 54, ARTICLE III, OF THE CODE OF ORDINANCES OF THE CITY QUINCY, FLORIDA, REGARDNG TO THE CITY OF QUINCY MUNICIPAL POLICE OFFICERS’ AND FIREFIGHTERS’ RETIREMENT PLAN; AMENDING SECTION 54-59, TO IMPLEMENT THE CONCLUSIVE CANCER PRESUMPTION ESTABLISHED BY SECTION 112.1816, FLA. STAT., AND THE REBUTTABLE DISEASE PRESUMPTIONS UNDER SECTIONS 112.18, 112.181 AND 175.231, FLA. STAT.; BY AMENDING SECTION 54-59; AMENDING SECTION 54-61 TO EXTEND THE TERM OF SERVICE OF TRUSTEES FROM TWO TO FOUR YEARS; PROVIDING FOR THE REPEAL OF ANY ORDINANCE OR PARTS THEREOF IN CONFLICT HEREWITH; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE.

WHEREAS , the City Commission of the City of Quincy meet in regular sessions; WHEREAS, the City Commission is authorized and empowered to amend the City of Quincy Municipal Police Officers’ and Firefighters’ Retirement Plan (the “Plan”); and WHEREAS, the Florida Legislature has recognized that firefighters are in danger of elevated cancer risk and as a result created a conclusive duty related cancer presumption found in Section 112.1816, Fla. Stat.

WHEREAS, Section 112.1816, Fla. Stat. governs all Firefighter Pension Plans in Florida. WHEREAS, the Legislature has further determined additional in-line of duty presumptions related to for hepatitis, meningitis and tuberculosis, hypertension and heart disease found in Sections 112.18, 112.181 and 175.231 applicable to both Firefighters and Police Officers. WHEREAS, the City of Quincy desires to codify these presumptions as set forth in Statute in the Plan.

NOTE: Language is language proposed to be deleted, Underlined language is amended language, and *** represents sections that have been skipped and that remain unchanged.

WHEREAS, the City of Quincy desires to amend the term of service for Trustees appointed to the Board from Two to Four years.

NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF QUINCY, FLORIDA:

Section 1. Amendment of Section 54-59(d)(2)

The City Commission hereby amends Section 54-59(d)(2) as follows:

Sec. 54-59. - Basis, amount, and payment of retirement income.

(d) Disability retirement and retirement income.

(2) Disability retirement eligibility; in-line of duty presumptions . A participant will be considered totally disabled if, in the opinion of the board of trustees, he is wholly prevented from rendering useful and efficient service as a firefighter or police officer; and a participant will be considered permanently disabled if, in the opinion of the board of trustees, he is likely to remain so disabled continuously and permanently.

i. Non-rebuttable conclusive cancer presumption. The provisions of Section 112.1816, Fla. Stat. applicable to Firefighters are hereby codified within the Plan and are intended to be incorporated by reference as to Firefighters.

ii. Additional rebuttable presumption for hepatitis, meningitis and tuberculosis. The presumption provided for in this subsection ii. shall apply only to those conditions described in this subsection (b) that are diagnosed on or after January 1, 1996.

iii. Rebuttable Presumption for hypertension and heart disease. Any condition or impairment of health of a member caused by hypertension or heart disease shall be presumed to have been suffered in the line of duty unless the contrary is shown by competent evidence, provided that such members shall have successfully passed a physical examination upon entering into such service, including cardiogram, which examination failed to reveal any evidence of such condition; and provided further, that such presumption shall not apply to benefits payable or granted in a policy of life, insurance or disability insurance. The provisions of sections 112.18, 112.181 and 175.231, Fla. Stat., are here by codified within the Plan, and are intended to be incorporated by reference. The Board of Trustees may adopt uniform administrative rules for the conduct of hearings resulting and related to these rebuttable presumptions, and the determination of any disqualifying events reflected in Chapters 112 and 175, Fla. Stat.

Section 2. Amendment of Section 54-61

Sec. 54-61. Administration.

(a) Administration by board of trustees. There is hereby created a board of trustees of the City of Quincy Municipal Police Officers’ and Firefighter’s Retirement Trust. The board of trustees shall consist of five members, two of whom, unless otherwise prohibited by law, shall be legal residents of the municipality, who shall be appointed by the legislative body of the city and one member of the board shall be a police officer as defined in F.S. § 185.02, and one member shall be a firefighter as defined in F.S. § 175.032, respectively, elected by a majority of the active firefighters and police officers who are members of the plan. The fifth member shall be chosen by a majority of the previous four members as provided for herein, and such person’s name shall be submitted to the legislative body of the city. Upon receipt of the fifth person’s name, the legislative body of the city, shall, as a ministerial duty, appoint such person to the board of trustees as its fifth member. The fifth member shall have the same rights as each of the other four members appointed or elected as herein provided and may succeed himself in office. Each resident member shall serve as trustee for a period of two four years, unless sooner replaced by the legislative body of the city, at whose pleasure he shall serve, and may succeed himself as a trustee. Each police officer and firefighter member shall serve as trustee for a period of two four years unless he sooner leaves the employment of the city as a police officer or firefighter, whereupon the legislative body of the city shall choose his successor in the same manner as an original appointment. Each police officer or firefighter may succeed himself in office. The board of trustees shall meet at least quarterly each year. The board of trustees shall be a legal entity with, in addition to other powers and responsibilities contained herein, the power to bring and defend lawsuits of every kind, nature, and description. The trustees shall by a majority vote elect a chairman and a secretary. The secretary of the board shall keep a complete minute book of the actions, proceedings, or hearings of the board. The trustees shall not receive any compensation as such, but may receive expense and per diem as provided by law.

Section 3. Conflict/Repeal:

All ordinances of Code provisions in conflict herewith are hereby repealed. Section 4. Severability. If any section, sentence, clause, phrase or provision of this Ordinance is held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not be construed as to render invalid or unconstitutional the remaining provisions of this Ordinance.

Section 5. Effective Date. This Ordinance shall take effect immediately upon adoption by the City of Quincy, Florida.
